An Italian court has now rules that staff should be allowed to watch pornography during their lunch breaks.
The ruling came about after judges said an employee at a Fiat factory near Palermo, Sicily, had done nothing wrong by viewing x-rated material at lunch and could not be fired.
Italy’s highest court, the Court of Cassation threw out an appeal from the car-maker which had wanted to dismiss the man.
According to the Local, the worker had claimed that his porn viewing was limited to ‘catching a glimpse’ of a film during his breaks.
The legal row started five years ago when a court in Termini Imeresi – near Palermo – found the employee guilty.
However, Palermo’s court of appeal later overturned the verdict – and its ruling was this week upheld by the Court of Cassation.
The court found that there was no evidence to suggest that the man had viewed porn during normal working hours.
According to the Economic Times, the court said in its ruling: ‘The evidence was insufficient to prove that the employee viewed porn during his working hours.’
In a separate case held on the same day, Fiat triumphed when the court found the car firm was allowed to fire an employee who smoked cannabis on his break.
