Man Arrested For Killing Neighbor’s Dog

HORNBY, New York — The New York State Police at Painted Post have arrested DANIEL R HARVEY, 38, of Hornby for Aggravated Cruelty to Animals and other charges following an investigation into the killing of a dog.

Daniel Harvey’s dog and a neighbor’s dog engaged in an inadvertent fight later Saturday evening which was broken up after the neighbor’s dog bit HARVEY as he attempted to break up the dogs with a stick. HARVEY did not require medical attention from the bite.

The next morning HARVEY walked to the neighbor’s residence with a single shot shotgun and shot the neighbor’s dog as it was in an enclosure. The dog was killed instantly. HARVEY returned to his residence where he was arrested without incident.

Harvey was arrested for the Aggravated Cruelty to Animals, as well as, Menacing in the Second Degree, Criminal Possession of a Weapon in the Fourth Degree and Discharging a Firearm within 500’ of a Residence.

It was determined that a previous criminal conviction for a serious offense precluded HARVEY from possessing weapons.

He was arraigned before T/J Ronald Yorio, Town of Erwin Court, and remanded to the Steuben County Jail on bail.

Hornby is a town in Steuben County, New York, United States. The population was 1,742 at the 2000 census. The name is from John Hornby, a land owner of the Pulteney Tract.
