A businessman was so angry after he was refused a drink after 11pm that he took it upon himself to demolish the building with a JCB digger, even though he owns the pub.

Surprisingly, he has not been charged, as he owns the premises and, as a police source says, ‘can do what he likes with it’.

Mark Swistun, 45, used the 28-ton digger to wreck the seaside pub in the middle of the night.

He was arrested on suspicion of causing criminal damage to the Royal Oak pub in the Welsh fishing village of Penclawdd, Gower.

But police said they were powerless to charge him because he jointly owns the pub.

A police source said: ‘At the end of the day the building belongs to him so he can do what he likes with it.

‘We would have needed someone to make an official complaint about the damage he caused.

‘No one came forward to do that.’

Wealthy factory owner Swistun invested £60,000 into the pub along with his business partner Colin McDonald, 59, just a year earlier.
