According to News 4 New York, the former Marine, who was captured on video holding Jordan Neely in a chokehold on an F train in Manhattan, resulting in Neely’s death, is expected to surrender and face charges as early as Friday.
The Manhattan District Attorney’s Office has reportedly made the decision to file charges, which was not presented to a grand jury.
As of now, there has been no information released on the specific charges that will be filed.
Penny’s legal team had previously stated that he could “not have anticipated” that his actions to subdue an alleged threat would result in death.
