Ex-Subway Pitchman Jared Fogle Appeals 15 Year Jail Term

The former convicted pedophile and Subway pitchman Jared Fogle is to appeal his 15 year jail term for sex crime charges and child pornography.

Fogle was jailed after he pleaded guilty last month to traveling to engage in illicit sexual conduct with a minor and distribution and receipt of child pornography.

Judge Tanya Walton Pratt chose to hand down a harsher sentence than the 12.5 years sought by prosecutors, ordering him to spend 15 years and 8 months in prison, followed by lifetime supervision after his release.

Fogle attorney Ron Elberger filed the notice to appeal in U.S. District Court in Indianapolis yesterday, the Star Tribune reports.

The appeal will be heard by the Seventh Circuit Court of Appeals in Chicago. Fogle’s arguments in his appeal are due to be heard on January 25.

At his sentencing, Judge Pratt said Fogle had been living a double life and engaged in perversion and lawlessness. She also rejected a defense expert’s opinion concerning Fogle’s sexual disorder.

‘There’s no such thing as being a mild pedophile,’ Pratt said. ‘That’s not a diagnosis.’

The judge recommended that Fogle serve his sentence in a prison in Littleton, Colorado, which has a program for sex offenders. 

Fogle had 600 pornographic images featuring minors in his possession at the time of a July raid on his home, and that he spent at least $12,000 per year on prostitutes.
