HORNBY, New York — The New York State Police at Painted Post have arrested DANIEL R HARVEY, 38, of Hornby for Aggravated Cruelty to Animals and other charges following an investigation into the killing of a dog.<\/p>\n
Daniel Harvey\u2019s dog and a neighbor\u2019s dog engaged in an inadvertent fight later Saturday evening which was broken up after the neighbor\u2019s dog bit HARVEY as he attempted to break up the dogs with a stick. HARVEY did not require medical attention from the bite.<\/p>\n
The next morning HARVEY walked to the neighbor\u2019s residence with a single shot shotgun and shot the neighbor\u2019s dog as it was in an enclosure. The dog was killed instantly. HARVEY returned to his residence where he was arrested without incident.<\/p>\n
Harvey was arrested for the Aggravated Cruelty to Animals, as well as, Menacing in the Second Degree, Criminal Possession of a Weapon in the Fourth Degree and Discharging a Firearm within 500\u2019 of a Residence.<\/p>\n
It was determined that a previous criminal conviction for a serious offense precluded HARVEY from possessing weapons.<\/p>\n
He was arraigned before T\/J Ronald Yorio, Town of Erwin Court, and remanded to the Steuben County Jail on bail.<\/p>\n
