Manhattan District Attorney Cyrus R. Vance, Jr., today announced the indictment of Eugene Miller, 32, for fatally shooting his ex-girlfriend, 30-year-old Rosetta Ewell, in the hallway outside of their child’s Harlem daycare center in July 2015. The defendant is charged in a New York State Supreme Court indictment with one count of Murder in the Second Degree.

“This cold-blooded shooting of Rosetta Ewell, a young mother of two, truly shocks the conscience,” said District Attorney Vance. “Unwilling to accept that Ms. Ewell ended their relationship, this defendant allegedly lay in wait as she dropped off their two-year-old daughter at daycare, before confronting her and shooting her multiple times in the face just outside of the daycare’s entrance.”

According to court documents and statements made on the record in court, beginning at approximately 8:00 a.m. on July 24, 2015, Miller hid in the staircase of the West 139th Street building where he knew Ms. Ewell, his ex-girlfriend with whom he had two children in common, would soon be arriving to drop off their two-year-old daughter. Ms. Ewell arrived approximately an hour later, and dropped off their child. As she waited for the elevator, the defendant emerged from the staircase, confronted the victim, and shot her three times in the face. Miller fled, and was apprehended in October 2015 by members of the NYPD’s Manhattan Warrants Squad.

The defendant is charged with Murder in the Second Degree, a class A felony, one count.
