Hunter Biden Seeks Dismissal of Federal Gun Charges

Attorneys representing Hunter Biden took action on Monday, filing a motion seeking the dismissal of firearms charges against him. Hunter Biden’s legal team, led by lawyer Abbe Lowell, contends that the charges are “unprecedented” and “unconstitutional.” They further assert that the charges violate a previous diversion agreement that was established with Delaware U.S. Attorney and special counsel David Weiss.

Hunter Biden, who is the son of President Biden, is additionally challenging Weiss’ appointment as special counsel. The argument put forth is that Weiss’s prior role as U.S. attorney in Delaware disqualifies him from holding the post of special counsel.

The indictment against Hunter Biden was issued in September by a federal grand jury and pertains to his acquisition of a firearm in October 2018 while he was reportedly a drug user, as outlined in court documents.

The grand jury, convened in Delaware, produced a four-page indictment charging Hunter Biden with three felony counts related to his possession of a Colt Cobra 38SPL revolver in October 2018.

Hunter Biden’s legal team contends that the charges are excessive, emphasizing that they lack support from the facts or align with Justice Department policy.
